The University judicial system is an intentional educational process, designed to hold students accountable for their behavior, to protect the University community and property, and to protect the rights of the members of that community to function in an environment conducive to academic pursuits. The judicial hearing and subsequent sanctions are meant to confront individuals with the inappropriateness of their actions in a constructive and educational manner that will foster an understanding of the impact their behavior has had on individuals and the community.
1. If a student has been found in violation of proscribed conduct, the notice of sanction letter will be mailed and/or e-mailed to the student's local address within seven business days of the hearing date. A copy of this letter will be kept in the student's judicial file in the office of the dean of students. Other than University expulsion, disciplinary sanctions shall not be made part of the student’s permanent academic record, but shall become part of the student’s disciplinary record. All judicial records are destroyed 3 years after graduation, except that the judicial records of students expelled or who do not return from a suspension are retained indefinitely.
2. A student's history of past judicial violations and the nature or severity of an incident is considered in determining appropriate sanctions.
3. Failure to fulfill judicial sanctions by the assigned due date shall result in a judicial hold on the student account. When a judicial hold is placed on an account, the student may not obtain transcripts or grades, register for classes, engage in on-campus housing sign-ups, be eligible to move off campus or be allowed to transfer between colleges/schools for a particular time period. In more serious judicial cases, failure to complete assigned sanctions can result in additional sanctions being imposed, including suspension from the University. It is the student's responsibility to ensure that documentation of completion of sanctions is recorded/received and approved by the dean of students.
4. Upon a finding of proscribed conduct, the sanctions, including but not limited to, those listed below, may be imposed by the appropriate judicial body. Particular sanctions are not necessarily associated with particular violations, and more than one of the sanctions listed below may be imposed for any single violation.
Alcohol Education Course – the student is required to complete and pass an on-line alcohol education course. There is a $50 charge to cover the cost of the course materials and licensing fees. The student must complete and pass the course within 3 weeks of the sanction letter. The student is responsible for ensuring that documentation for the completion of the sanctions is received, recorded, and approved by the dean of students. Parent(s) and/or legal guardian(s) of dependent students not yet 21 receive notification of judicial sanctions incurred for substance abuse violations by their son/daughter resulting from a judicial hearing.
Choices – second alcohol education course – the student is required to complete and pass an individualized CHOICES alcohol education course. There is a $50 charge to cover the cost of the course materials and licensing fees. The student must complete and pass the course within 3 weeks of the sanction letter. The student is responsible for ensuring that documentation for the completion of the sanctions is received, recorded, and approved by the dean of students. Parent(s) and/or legal guardian(s) of dependent students not yet 21 receive notification of judicial sanctions incurred for substance abuse violations by their son/daughter resulting from a judicial hearing.
Mandatory Counseling – a student must take part in a counseling program conducted by University staff or other licensed professional. It may be required that the student participate in a counseling program that addresses particular issues, such as substance abuse, and documentation of completion may be required.
Community Service - a student must complete a specified number of hours working in an area that will provide the student with an educational experience related to the violation. Completion deadline will be stipulated.
Drug Education Course - the student is required to complete and pass an on-line drug education course. There is a $50 charge to cover the cost of the course materials and licensing fees. The student must complete and pass the course within 3 weeks of the sanction letter. The student is responsible for ensuring that documentation for the completion of the sanctions is received, recorded, and approved by the dean of students. Parent(s) and/or legal guardian(s) of dependent students not yet 21 receive notification of judicial sanctions incurred for substance abuse violations by their son/daughter resulting from a judicial hearing.
Drug Education Course (2nd level) – the student is required to complete and pass an individualized drug education course. There is a $50 charge to cover the cost of the course materials. The student must complete and pass the course within 3 weeks of the sanction letter. The student is responsible for ensuring that documentation for the completion of the sanctions is received, recorded, and approved by the dean of students. Parent(s) and/or legal guardian(s) of dependent students not yet 21 receive notification of judicial sanctions incurred for substance abuse violations by their son/daughter resulting from a judicial hearing.
Disciplinary Probation – a status imposed for a specific period of time in which a student must demonstrate conduct that conforms to the University’s standards of conduct. It is a formal written notification to a student that the violation of the terms of the probation or further charges of any proscribed conduct may result in more severe judicial sanctions, including the possibility of University probation, suspension or expulsion from the University.
Expulsion – is a permanent separation from the University including loss of student status. Reinstatement or readmission is not possible.
Fire Safety Educational Course. There is a $50 charge to cover the cost of the course materials. The student must complete and pass the course within 3 weeks of the sanction letter. The student is responsible for ensuring that documentation for the completion of the sanctions is received, recorded, and approved by the dean of students.
Keep-away – a physical restriction that bans the student from a building, space or person.
Letter of Apology – the student is required to compose a letter to a designated person(s). The hearing officer or Dean may require approval of the letter prior to distribution.
Loss of Hosting Privileges – ineligible to have guests or visitors stay over night in their residence hall rooms.
Loss of Privileges – denial of specified privileges for a designated period of time.
Mandated Counseling Assessment - a student must take part in an assessment conducted by University staff or other licensed professional, it may be require for the student to participate in an evaluation to addresses particular issues, such as substance abuse, mental status, etc. and documentation of completion may be required.
Restitution - monetary reimbursement to the University, an individual, or an organization for repair or replacement of property damaged, stolen or misappropriated.
Residence Hall Probation – a formal written notification to a student that any violation of the terms of the proscribed conduct during the period of the probation will result in review and/or termination of the housing agreement.
Room Reassignment – mandatory reassignment of residence hall room.
Special Project – a requirement(s) that a student participate or assist in the planning and/or implementation of a program or project that is relevant to the violation.
Suspension - separation from the University community for a defined period of time. Additional stipulations or conditions for reinstatement may be assigned. Reinstatement is contingent upon a positive administrative review.
University Probation – a status imposed for a specific period of time in which a student must demonstrate conduct that conforms to the University’s standards of conduct. It is a formal written notification to a student that the violation of the terms of the probation or any further violation of the student code of conduct (may exclude residence life policies) will result in suspension or expulsion from the University.
Verbal Warning – a verbal notification given to a student whose behavior was found to be in violation of a student code of conduct or general university policy.
Written Warning – a written notification given to a student whose behavior was found to be in violation of a student code of conduct or general university policy. A letter of written warning is kept in the student’s judicial file.
