SEXUAL MISCONDUCT POLICY Alfred University affirms the rights of its students to live, work, and learn in an atmosphere of mutual respect, free from the threat of sexual assault or any other form of sexual contact without mutual consent. Accordingly, we are committed both to a campus-wide program of education and prevention and to a timely and appropriate response to credible reports of misconduct. I encourage students who believe they are victims of such misconduct to take advantage of University and community resources for assistance. When University staff receive such reports, they will assist in securing whatever support may be necessary - from crisis follow-up to reports to law enforcement authorities. Students have the option of initiating a formal campus investigation as well, with resulting disciplinary sanctions imposed as deemed necessary. Full details of such options are explained at the conclusion of the following text. Sexual misconduct clearly has no place on our campus or in our community. I am confident in our ability to prevent such activity and build a community of mutual respect and trust. University men and women are expected to conform to high standards of adult behavior, both on and off campus. Judicial action will be taken against students whose conduct adversely affects the University community and/or the pursuit of University objectives. It is the policy of Alfred University, in keeping with efforts to establish an environment in which the dignity and worth of all members of the institutional community are respected, to view Sexual Misconduct as unacceptable behavior, which is expressly prohibited. Alfred University defines Sexual Misconduct as sexual assault or any other form of unwanted sexual contact. It includes, but is not limited to, unwanted kissing, fondling, or otherwise touching another's private body parts. "Unwanted" means against a person's will or without one's consent, thus including those instances in which the victim is unable to give consent because s/he is a minor, unconscious, asleep, or intoxicated due to alcohol or other drugs. Sexual Misconduct can be perpetrated either by a stranger or acquaintance and both women and men can be victims and/or perpetrators. The purpose of this document is to set forth both the formal and informal procedures recognized by the University for use in those cases in which a Student is named as the Accused party in a charge alleging violation of the Sexual Misconduct Policy. Other unacceptable forms of behavior by or between Students are addressed in the University's Student Life Policies, such as the Sexual Harassment Policy and the Student Judicial System.
